OUVRAGE : L. Grover, Interpreting Crimes in the Rome Statute of the International Criminal Court

The Rome
Statute of the International Criminal Court defines more than ninety crimes
that fall within the Court's jurisdiction: genocide, other crimes against
humanity, war crimes and aggression. How these crimes are interpreted
contributes to findings of individual criminal liability, and moreover affects
the perceived legitimacy of the Court. And yet, to date, there is no
agreed-upon approach to interpreting these definitions. This book offers
practitioners and scholars a guiding principle, arguments and aids necessary
for the interpretation of international crimes. Leena Grover surveys the
jurisprudence of the International Criminal Tribunals for the former Yugoslavia
and Rwanda before presenting a model of interpretive reasoning that integrates
the guidance within the Rome Statute into articles 31-33 of the Vienna
Convention on the Law of Treaties (1969).

La Première
Commission de l’Assemblée générale de l’ONU chargée du désarmement et de la
sécurité internationale a terminé le 21 octobre son débat thématique sur les
armes nucléaires. Comme lors des
précédentes séances, tous les États non dotés ont déploré le manque de progrès
dans le désarmement nucléaire, rappelant l’équilibre indispensable entre les
trois piliers du Traité sur la non-prolifération des armes nucléaires (TNP) de
1968 : désarmement, non-prolifération et droit à l’utilisation pacifique de
l’énergie nucléaire.

In this book, transparency is dealt with as a methodological principle of governance, whether governance takes on a unilateral or a contractual mode, whether it impacts legislative, administrative, or judicial action, and whether the unilateral or conventional acts are taken by public or private persons. This global approach to transparency contrasts with the segmented approach which prevails in the existing literature. With the many ramifications of transparency, and their interactions, being thus uncovered, this new way of studying transparency makes it possible to map out both the diversity and the unity of the concept. Moreover, this inquiry is conducted by a diverse group of jurists, representing both public law and private law, Europe and North-America. Thanks to the combination of the global and comparative dimensions, this book definitely embarks on the construction of a true law of transparency and furnishes a new theoretical foundation to transparency.

ACTU : Roberto Azevêdo déplore que l’impasse de Bali paralyse les travaux de l’OMC

Le 16 octobre, le directeur général de l’OMC, Roberto Azevêdo, a indiqué au
Comité des négociations commerciales que, malgré des consultations intensives,
il n’avait pas été possible de “trouver une solution pour sortir de l’impasse”,
plus de deux mois après la date butoir concernant l’Accord sur la facilitation
des échanges. “Ce pourrait être la situation la plus grave que cette
Organisation ait jamais connue”, a-t-il déploré. Même si les membres devraient
continuer de s’efforcer de trouver une solution à l’impasse actuelle, “nous
devrions aussi réfléchir à nos prochaines étapes”, a-t-il ajouté.

This has been caused in large part by the increasingly important role that international organizations have played in exercising powers conferred on them by national Governments. This phenomenon has led to concerted attempts by States, international courts and tribunals, and domestic courts to seek to ensure accountability for these exercises of power by imposing corresponding limits on international organizations.

L'article "Intégrer le droit des droits de l’homme : une exploration" du dossier "Intégration du droit des droits de l’Homme" essaie d’imaginer une approche intégrée du droit des droits de l’Homme. En tant que projet politique et éthique, les droits de l’Homme sont un, indivisibles et universels. En tant que droit cependant, ils sont fragmentés. Le présent article veut entamer une conversation sur la question de savoir s’il est opportun de poursuivre une approche intégrée du droit des droits de l’Homme au niveau de leur mise en œuvre, en défendant une telle approche intégrée, plus ou moins intense.

ACTU : Malgré leurs arriérés de paiement au budget de l’ONU, les Comores, la Guinée-Bissau, Sao Tomé-et-Principe et la Somalie devraient être autorisés à voter

La Cinquième Commission chargée des questions administratives et
budgétaires a recommandé, le 8 octobre, à l’Assemblée générale, d’autoriser les Comores, la Guinée-Bissau,
Sao Tomé-et-Principe et la Somalie à exercer leur droit de vote jusqu’à la fin
de cette soixante-neuvième session, malgré leurs arriérés de paiement au budget
ordinaire de l’ONU. La Commission a, par ailleurs, été saisie de la
situation budgétaire et financière de 35 entités du système de l’ONU.

In the last issue 2/2014 we opened the content with the EU Arctic policy - this time we introduce a new abbreviation: OCT, which means Overseas Countries and Territories, a number of small caillou-type territories all over the oceans, belonging to EU Member States and therefore also part of the EU - somehow. They have a special relation grid with the EU, and this is what Ofelya Sargsyan writes about.
