ACTU : Le Burkina Faso, le Mali et le Niger annoncent leur retrait de la CEDEAO

La Communauté économique des États de l'Afrique de l'Ouest (CEDEAO) a été créée par un accord multilatéral entre 15 États de l'Afrique de l'Ouest ayant signé son Traité constitutif le 28 mai 1975. Conformément à l'article 3 dudit traité, la CEDEAO vise à « promouvoir la coopération et l'intégration dans la perspective d'une union économique de l'Afrique de l'Ouest en vue d'élever le niveau de vie de ses peuples, de maintenir et d'accroître la stabilité économique, de renforcer les relations entre les États membres et de contribuer au progrès et au développement du continent africain ». Toutefois presque 50 ans après sa naissance, l'organisation fait face à une crise existentielle. Par un communiqué du 28 janvier 2024, le Burkina Faso, le Mali et le Niger ont annoncé leur retrait « sans délai », invoquant notamment les attentes de leurs peuples, les sanctions « illégales et inhumaines et humiliantes » qui ont été prises à leur encontre, mais aussi l'instrumentalisation de l'instance par des forces étrangères.

ACTU : Situation en Ukraine : le président russe et la commissaire russe aux droits de l’enfant visés par des mandats d'arrêt de la CPI

Dans le cadre de l’enquête ouverte il y a un an sur d'éventuels crimes relevant de sa compétence commis en Ukraine depuis l'offensive militaire russe du 24 février 2022, la Cour pénale internationale (CPI) a émis, le 17 mars, deux mandats d’arrêt : l’un contre le président russe, Vladimir Poutine, l’autre contre la commissaire présidentielle aux droits de l’enfant en Russie, Maria Alekseyevna Lvova-Belova. Tous deux sont accusés de crimes de guerre consistant dans la déportation et le transfert illégaux d'enfants ukrainiens des régions occupées de l'Ukraine vers la Fédération de Russie, en violation des articles 8(2)(a)(vii) et 8(2)(b)(viii) du Statut de Rome.

OUVRAGE : M. Kersten, The Effects of the International Criminal Court's Interventions on Ending Wars and Building Peace

What happens when the international community simultaneously pursues peace and justice in response to ongoing conflicts? What are the effects of interventions by the International Criminal Court (ICC) on the wars in which the institution intervenes? Is holding perpetrators of mass atrocities accountable a help or hindrance to conflict resolution? This book offers an in-depth examination of the effects of interventions by the ICC on peace, justice and conflict processes. The "peace versus justice" debate, wherein it is argued that the ICC has either positive or negative effects on "peace", has spawned in response to the Court's propensity to intervene in conflicts as they still rage. This book is a response to, and a critical engagement with, this debate.

OUVRAGE : S.M. Meisenberg, I. Stegmiller (eds.), The Extraordinary Chambers in the Courts of Cambodia: Assessing their Contribution to International Criminal Law

This book is the first comprehensive study on the work and functioning of the Extraordinary Chambers in the Courts of Cambodia (ECCC). The ECCC were established in 2006 to bring to trial senior leaders and those most responsible for serious crimes committed under the notorious Khmer Rouge regime. Established by domestic law following an agreement in 2003 between the Kingdom of Cambodia and the UN, the ECCC’s hybrid features provide a unique approach of accountability for mass atrocities. The book entails an analysis of the work and jurisprudence of the ECCC, providing a detailed assessment of their legacies and contribution to international criminal law. The collection, containing 20 chapters from leading scholars and practitioners with inside knowledge of the ECCC, discuss the most pressing topics and its implications for international criminal law. These include the establishment of the ECCC, subject matter crimes, joint criminal enterprise and procedural aspects, including questions regarding the trying of frail accused persons and the admission of torture statements into evidence.
