REVUE : "Fissures dans l'atlantisme", Recherches internationales (n°134, automne 2025)

Alexis COSKUN, Pierre GUERLAIN, Michel ROGALSKI

OUVRAGE : M. Svicevic, The United Nations Security Council and the Authorisation of Force: Form, Character and Nature

Marko SVICEVIC

This book examines the United Nations Security Council's authorisation of the use of force, considering the extensive body of UN Security Council resolutions across its now eighty years of existence.

As one of the established exceptions to the Article 2(4) UN Charter prohibition on the use of force, UN Security Council authorisation of force remains a key focus for both States and scholars alike. Despite the apparent consequences of authorisation, authorising resolutions lack prescribed formats or mandatory content. The UN Security Council has over time, however, developed a consistent practice of prior explicit authorisation.

The development of this practice is reflected in a number of essential characteristics within authorising resolutions of the UN Security Council. These include explicit determinations of a threat to international peace and security, the invocation of Chapter VII (or VIII) of the UN Charter, the use of specific authorising language, the inclusion of time or functional limits on authorisation, and the imposition of reporting obligations on those authorised to use force. The book ultimately argues that prior explicit authorisation constitutes a well-established practice, rejecting the legality and admissibility of implicit and retroactive authorisation.

OUVRAGE : K. Egeland, The Struggle for Abolition: Power and Legitimacy in Multilateral Nuclear Disarmament Diplomacy

Kjølv EGELAND

Can the genie be returned to the bottle? This book investigates the pursuit by states, civil society groups, and international organisations of nuclear abolition. OUVRAGE : C. Cai, L. van der HERIK, T. Maluwa, The UN Security Council and the Maintenance of Peace in a Changing World

Congyan CAI, Larissa van den HERIK, Tiyanjana MALUWA

How can the UN Security Council contribute to the maintenance of international peace and security in times of heightened tensions, global polarisation, and contestation about the principles underlying the international legal and political order? In this Trialogue, experts with diverse geographic, socio-legal, and ideational backgrounds present their perspectives on the Security Council's historic development, its present functions and deficits, and its defining tensions and future trajectories. Three approaches engage with each other: a power-focused approach emphasising the role of China as an emerging actor; an institutionalist perspective exploring how less powerful states, particularly the elected members of the Security Council, exert influence and may strengthen rule-of-law standards; a regionalist perspective investigating how the Security Council as the central actor can cooperate with regional organisations towards maintaining international peace and security.

OUVRAGE : J.A. Green, Collective Self-Defence in International Law

James A. GREEN

Collective self-defence can be defined as the use of military force by one or more states to aid another state that is an innocent victim of armed attack. However, it is a legal justification that is open to abuse and its exercise risks escalating conflict. Recent years have seen an unprecedented increase in the number of collective self-defence claims. It has been the main basis for US-led action in Syria (2014-) and was advanced by Russia in relation to its full-scale invasion of Ukraine (2022-). Yet there still has been little analysis of collective self-defence in international law. This book crucially progresses the debate on various fundamental and under-explored questions about the conceptual nature of collective self-defence and the requirements for its operation. Green provides the most detailed and extensive account of collective self-defence to date, at a time when it is being invoked more than ever before.

OUVRAGE : E. Pobjie, Prohibited Force: The Meaning of ‘Use of Force' in International Law

Erin POBJIE

Prohibited 'use of force' under article 2(4) of the UN Charter and customary international law has until now not been clearly defined, despite its central importance in the international legal order and for international peace and security. This book accordingly offers an original framework to identify prohibited uses of force, including those that use emerging technology or take place in newer military domains such as outer space. In doing so, Erin Pobjie explains the emergence of the customary prohibition of the use of force and its relationship with article 2(4) and identifies the elements of a prohibited 'use of force'. In a major contribution to the scholarship, the book proposes a framework that defines a 'use of force' in international law and applies this framework to illustrative case studies to demonstrate its usefulness as a tool for legal scholars, practitioners and students.

Olivier BICHSEL, Olivier DELAS, Carla GOMEZ, Mulry MONDÉLICE, Richard OUELLET

OUVRAGE : S. Furuya, H. Takemura, K. Ozaki (eds.), Global Impact of the Ukraine Conflict: Perspectives from International Law

Shuichi FURUYA, Hitomi TAKEMURA, Kuniko OZAKI

The invasion of Ukraine by the Russian Federation on February 24, 2022, and the subsequent military campaigns entail several classical aspects of armed conflict. First, it is a type of international armed conflict between two sovereign States that had been prevalent until the middle of the twentieth century but not in the last several decades. It is also a direct intervention by a superpower into a neighboring State with the former’s aspiration of territorial expansion. This action evokes a scheme of war reminiscent of the nineteenth or early twentieth century. At the same time, however, the invasion is generating in the international community a sense of new phenomena, leading to a new era that may be different from the past three decades following the end of the Cold War. In fact, the hostilities between the Russian Federation and Ukraine, as well as reactions by other States and international organizations, have raised legal and political issues that require scholars to reexamine existing frameworks of the international community and individual rules of international law.

OUVRAGE : D. Kritsiotis, O. Corten, G.H. Fox (eds.), Armed Intervention and Consent

Dino KRITSIOTIS, Olivier CORTEN, Gregory H. FOX

In the past decade, numerous military operations by outside states have relied on the real or alleged 'invitation' of one of the parties. In this book, three experts examine the relevant legal issues, from sovereignty to the scope and relevance of consent, the use of force to the role of the Security of Council. Using critical historical analysis, qualitative case studies and large-N empirics, these topics are debated and addressed in a unique trialogue format. Accommodating the pluralism of the field, the trialogical setting highlights the divergences and commonalities of each of the three approaches.

Benefiting from an in-depth analysis of recent cases of armed intervention and the diversity of the authors' perspectives, this collection is key to developing a richer understanding of the law of military intervention. This title is also available as Open Access on Cambridge Core.

OUVRAGE : A. Vicente, P. Sinovets, J. Théron (eds.), Russia’s War on Ukraine. The Implications for the Global Nuclear Order

Adérito VICENTE, Polina SINOVETS, Julien THÉRON

This book explores how Russia’s War on Ukraine has changed the global nuclear order. The Russian aggression against Ukraine questioned the values of the liberal regimes and systems upon which the global nuclear order is built. At the heart of this nuclear order lies the 1968 Treaty on the Non-Proliferation of Nuclear Weapons (NPT), which remains until today the cornerstone of the global nuclear disarmament and nonproliferation regime.

OUVRAGE : S. Marquardt, S. Blockmans (eds.), The European Union's Contribution to International Peace and Security. Liber Amicorum in honour of Gert-Jan van Hegelsom

Stephan MARQUARDT, Steven BLOCKMANS

The Treaty of Lisbon has significantly enhanced the EU’s institutional framework and the instruments at its disposal in foreign policy and external relations, notably through the creation of the function of the High Representative, supported by the European External Action Service. Contributing to the maintenance of international peace and security is one of the core objectives of the EU’s external action. This volume, with contributions from legal experts on EU foreign policy and external relations, illustrates the manifold legal issues arising in EU external action and in its efforts to achieve this essential objective.
